Being Proactive.

There have been a few personally close and unexpected deaths and health issues recently. For one in particular, along with everything else the family has to deal with, the deceased did not have estate documents and/or polices in place and now the family is left scrambling and asking for donations, just to keep the child in extracurricular activities. It is truly devastating.
This is just one out of a few recent stories that have pushed me write this post.
It made me realize that estate planning is sort of like health, it is much easier to maintain than to get back. Once traumatic events happen, we can no longer obtain those policies or needed documents.
Most of us, when we are healthy, think we will always be healthy. But the truth is, we know the cycle of life and that unexpected events happen all of the time. Yet, it is so easy to brush off these relatively simple and inexpensive documents and policies, in the belief that it will not happen to us, until it does.
Being that I work in this area of law, it is especially close to my heart because I know that much of the financial, technical, and legal difficulties the family is dealing with, could have been avoided.
So if time is the reason you do not want to do your estate planning, I can assure you, you will be happy you did in a time of need. When you need a person to be able to pay your bills or sign a medical document because of a temporary state of incapacity, you will be happy you spent a couple days putting together these necessary documents.
If money is the reason you do not want to put estate planning documents in place, it will likely cost you much more to have the court decide your intentions for you.
If you are unsure of your wishes, or later change your mind, most of the documents can be amended. It is better to put something in place and later change it, than to have nothing at all.
